The following privacy policy ('Policy') describes how Spathe Inc ('Spathe') collects and uses information it receives from visitors to the Spathe web site or service ('Site'). This policy applies only to information collected through this Service and not to information collected offline.

1.         What Personally Identifiable Information Is Collected

Spathe does not collect personally identifiable information on the Site or through its Service unless you voluntarily provide information about yourself via an electronic mail message or by filling out one of its online forms. Personal information means data that is unique to an individual, such as a name, address, credit card number, email or telephone number. For example, if you send Spathe an email or request a whitepaper through the Site, it may use the information you provide to follow up via telephone or email (see Section 6 of this policy on how to opt-out of receiving these communications). The information you provide will be kept confidential and will be used only to support your continued relationship with Spathe. No software or hardware techniques are employed to capture a visitor's email address or other personally identifiable information.

As is the case with many web sites, the Site uses a technology called cookies, which are small data files that are downloaded onto your computer. The use of cookies is a standard practice on the Internet, and allows Spathe to tailor your visits to the Site to your individual preferences.

Spathe does not use invisible images to track how you use the Site. Spathe's hosting systems do collect anonymous, aggregate information or statistics related to web site usage. These statistics indicate the total number of hits, the total number of page hits, the number of kilobytes transferred from the web site, and the IP address of the visitor. When monitoring traffic patterns, Spathe is only able to measure the number of visitors to the Site and the addresses of the web sites from which visitors come. Email addresses and other personally identifiable information are not available to Spathe.

2.         How the Information You Provide Is Used

Should you send Spathe your comments or questions via email to any address provided on the Site, it will only share your communications with its employees or agents most capable of addressing your questions and concerns. Spathe will retain your communication until it has done its best to provide you with a complete and satisfactory response and then Spathe will either discard it or, in some cases, archive it. Spathe will only disclose personal information if it is required to do so by law or we in good faith believe that such action is necessary to (a) comply with the law or with court orders, subpoenas, judicial proceeding, or legal process; (b) protect and defend its rights and property; (c) protect against misuse or unauthorized use of its web site; or (d) protect the personal safety or property of its users or the public. Spathe does not sell, rent or otherwise disclose its mailing lists or other personally identifiable information you may provide without your consent.

3.         Security of Information Sent to Us

Please note that, unless Spathe expressly advises you otherwise, the email functionality on the Site does not provide a means for completely secure and private communications between Spathe and you. Like all unencrypted Internet email communications, your email may be accessed and viewed by other Internet users, without your knowledge and permission, while in transit to us. For that reason, to protect your privacy, please do not use email to communicate information to us that you consider to be confidential. Although we strive to protect your personal information, Spathe cannot ensure or warrant the security of any information you transmit to it, and you do so at your own risk. Once Spathe receives your transmission, it will use all commercially reasonable efforts to ensure its security on all internal systems. Access to confidential information is restricted to those individuals who require the information for Spathe development and support activities. These may include Spathe employees, partners, contractors and other agents working with Spathe to develop, improve or deliver Spathe-related applications, services or products. These parties are bound by Spathe's confidentiality agreement and privacy policy; failure to meet the company's privacy requirements may be subject to penalties including termination and/or criminal prosecution. Depending on the nature of the inquiry, your communication may be discarded or archived. If you wish, you may contact Spathe instead via telephone at the numbers provided throughout the Site.

The Site uses SSL encryption to transmit sensitive information.

4.         Disclosure of Customer Information Through Business Transfers

As Spathe continues to develop its business, it may buy, merge or partner with other companies or businesses, and in so doing, acquire customer information. In such transactions, user information may be among the transferred assets. Similarly, in the unlikely event that a portion or substantially all of Spathe's assets are sold or transferred to a third party, the information you have voluntarily provided to it, including your email address, would likely be one of the transferred business assets. Spathe has service providers for billing, analytics, and marketing, but the data collected is for internal use only.

Spathe posts customer testimonials on the site that contain personally identifiable information such as the customer's name. Spathe obtains the customer's consent prior to posting the testimonial to post their name along with their testimonial.

If you use a blog, bulletin board, or chat room on the Site, you should be aware that any personally identifiable information you submit there can be read, collected, or used by other users of these forums, and could be used to send you unsolicited messages. Spathe is not responsible for the personally identifiable information you choose to submit to these forums.

5.         Privacy Policies of Web Sites Not Under Spathe's Control

For your convenience, this Site may provide links to various web sites that Spathe does not control. When you click on one of these links, you will be transferred out of the Site and connected to the web site of the organization or company that you selected. Inclusion of any linked web site on this Site does not imply or express an approval or endorsement of the linked web site by us, or of any of the content, opinions, products or services provided on these web sites. Even if an affiliation exists between the Site and a third-party web site, Spathe exercises no control over linked sites. Each of these linked sites maintains its own independent privacy and data collection policies and procedures. If you visit a web site that is linked to from the Site, Spathe encourages you to consult that web site's privacy policy before providing any personal information and whenever interacting with any web site.

6.         Access and Correction

You have a right to know about the personal information that Spathe has collected as described above, including the right to correct, amend or delete the information that Spathe has on file if it is incorrect. Users may update any of their personal information via the My Profile page once logged into the application. You may edit any of the information on this page and click save to update, change, or correct any information. You also may change the status of whether you wish to receive Spathe alerts or notifications, newsletters and communications at anytime. If at any time you wish to exercise these rights, feel free to contact Spathe at support@spathe.com. If you wish to unsubscribe from the newsletter, click the unsubscribe link included in every newsletter.

Spathe also collects third party personal information including first and last name as well as email address on the Site via the 'Invite' function when logged into your account.

Spathe automatically sends the invitee a one-time email inviting him or her to visit the Site.

7.         Modifications to This Privacy Policy and Site

 

By using this Site, you signify your agreement to the terms of this Policy. If you do not agree with the terms of this Policy, please do not disclose any personal information through this Site.

Please note that Spathe may change the content or design of the Site, and consequently, this Policy at any time in the future. Notice of any revisions will be posted to this page and on the home page of this Site, so please revisit this page from time to time to ensure that you are aware of any changes to it. You are responsible for reviewing this Policy periodically, and your continued use of the Site following any modifications to this Policy will be conclusively deemed acceptance of any changes.

8.         Governing Law

This Policy and the use of this Site are governed by the Commonwealth of Massachusetts law. Any claim related to the Site or this Policy shall be brought in a federal or state court in Massachusetts. Users of this Site consent to the jurisdiction and venue of such court as the most convenient and appropriate for the resolution of disputes concerning this Policy.
